Terms of Use

This Terms of Use agreement (the "Agreement") governs your access to and use of the SaaS application (the "Service") provided by Generellem ("Generellem"). By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement. If you do not agree to all of the terms and conditions of this Agreement, you are not authorized to use the Service.

Components of the Service

The Service includes both desktop and cloud components. The desktop component is a software application that you install on your computer. The cloud component is a web-based application that you access through a web browser.

Offerings

The Service is offered in two versions: open-source and enterprise. The open-source version is free to use and distribute. The enterprise version is a paid subscription service that offers additional features and support.

Fees

The enterprise version of the Service is subject to fees. The fees are set out in the applicable subscription agreement.

Artificial Intelligence

The Service includes artificial intelligence (AI) components. You agree to use the AI components in a responsible and ethical manner. You will not use the AI components to perform any actions that break the law, circumvent the intended purpose of the AI, or engage in immoral actions.

Prohibited Uses

You agree not to use the Service for any of the following purposes:

To violate any applicable law, statute, ordinance, or regulation.
To infringe on the intellectual property rights of others.
To transmit or store any material that is defamatory, obscene, threatening, harassing, abusive, hateful, or otherwise objectionable.
To interfere with the use and enjoyment of the Service by others.
To attempt to gain unauthorized access to the Service or any systems or networks connected to the Service.
To develop or use any third-party applications that interact with the Service in a way that is not authorized by Generellem.

Termination

Generellem may terminate your access to the Service at any time, for any reason, without notice.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck from this Agreement and the remaining provisions shall remain in full force and effect.

Waiver

No waiver of any provision of this Agreement shall be effective unless in writing and signed by both parties.

Headings

The headings in this Agreement are for convenience only and shall not affect its interpretation.

Counterparts

This Agreement may be executed in one or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Generellem DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Generellem ALSO DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR THAT THE RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR TIMELY.

You agree that you use the Service at your sole risk and that Generellem will have no liability for any damages arising out of your use of the Service, including, but not limited to, direct, indirect, incidental, consequential, special, or punitive damages.
